Bringing a Personal Injury Claim

Starting a claim

We will need to see you to find out all of the details of your accident and injury but after that we try to avoid any inconvenience to yourself although any medical appointments should be attended and of course requests for information answered. We will keep you updated as to what is happening and if you have any concerns you should not hesitate to call the solicitor who is advising you

Negligence and fault

To bring a successful claim we have to show that the Defendant in your accident, whether they are, for example, your employer, another driver on the road or the local authority, has been negligent and that this wrongdoing caused your accident and your injuries. We can do this using your description of what happened. We can also use witness statements from other people who may have been there or who can provide useful information about the circumstances of the accident.

When we inform the Defendants that we are bringing a claim on your behalf they have to tell their insurers about the claim and the insurance company have to investigate all we say about how the accident occurred. If they then admit liability we can then hopefully settle your claim. If they dispute liability we can then see what evidence they have and continue to fight your claim.

Your injury

The evidence that we use to assess how much your claim is worth is firstly medical evidence. We get an expert medical report from a Consultant about your injuries. They will have a meeting with you to discuss the injuries and see how you are recovering. We try to keep appointments to see Consultants to a minimum. Usually there is just one independent consultant in a claim. This does however depend on how complicated and serious the injuries are. We can then send the report to the Defendants and negotiate an agreement as to the value of your claim.

Your losses

In relation to any financial losses we can claim back the cost of anything that you have reasonably paid out for because of the accident. We can also recover money that you did not get paid from work whilst you were off sick. This can include overtime and bonuses.
