No Win - No Cost To You

If you get no compensation then you do not have to pay anything. We want to take the risk instead of you; that is why it is called No Win No Fee. We only get paid if the claim is successful and if your claim is successful then we want the Defendants to pay your legal costs, i.e. the fee we charge for bringing your claim so that you do not have to. We need an agreement with you at the outset of your claim that protects your position and enables us to claim these legal costs from the Defendants. We want to ensure that your money is not at risk and that, if possible, your claim costs you nothing whether we win or lose.

The options available for personal injury claims are varied and some are discussed below. We can advise as to what will suit you best. The important thing is that you are confident in any arrangement we have. Lots of people are interested in No Win No Fee and we can offer this funding for most types of injury claims.

No Win No Fee

No Win No Fee is an agreement between you and us that if the claim is not successful we will not charge you anything for the work that we have done on your behalf. However what this does not do is protect your position in relation to the Defendant’s legal costs. If the Claim is lost after the issue of court proceedings then you might have to pay legal costs. We try and make sure you have some kind of insurance that protects you should this ever happen. There are lots of ways this can be put in place – eg via existing legal expenses insurance that you might already have or by buying a new policy to cover you. Again we will make every effort to ensure that this costs you nothing and at our first meeting we can determine what will suit your particular claim best.

We appreciate that solicitor’s fees can seem expensive and worrying but please be reassured that what we will try and do is set up an arrangement that means you risk very little if anything at all in starting a claim.

The risk of losing can be our risk and not yours. We can then charge the Defendants extra for taking that risk, i.e. the risk of losing. Any success fee type of payment that we charge for bearing that risk in your claim is not paid by you but is paid by the Defendants on top of the basic legal costs and your compensation.

As the claim progresses there are other expenses that are incurred for example the cost of the expert medical evidence about your injury. These costs must be covered whilst your claim is ongoing. We will make every effort to ensure that you do not risk this money and again different options are available that we can discuss with you. We will try to avoid you having to pay anything.

Legal Aid/Public Funds

Unfortunately Legal Aid is no longer available for the majority of personal injury claims, such as road traffic accidents and accidents at work, whatever your personal circumstances. However it is still available for Clinical/Medical Negligence claims and whether it is available to you remains dependant upon your income. We have a franchise from the Legal Services Commission (LSC) giving us specific authority to use public money to cover the legal costs of such a claim. Insurance

It may be that you already have some means to pay for a legal claim for compensation as lots of household and/or motor insurance policies have this facility attached. We can advise about this if you bring your policy to the free first interview. There are also insurance policies available that insure against you having to pay any legal costs that are separate from No Win No Fee - we can advise about this possibility. However if we can use a pre-existing policy then we shall do as this is usually simpler than setting up something new. Our first concern is what is better for you and we will always look at all the options.

The cost of bringing a legal claim need not be costly for you. We provide a professional and efficient service however your claim is paid for. We do not believe that you should have to risk further money in bringing a claim against the person or organisation that has already injured you.
