This is important both for the protection of the public giving money to charities, for the reputation of charities generally and to ensure that the trustees/directors of the charity do not expose themselves to personal liability.

- Establishment of the charity – whether the appropriate vehicle is a charitable company limited by a guarantee or a charitable trust or a charitable unincorporated association or a charitable incorporated organisation.
- What is the correct structure for your charity?
- Our charity lawyers can draft appropriate constitution documents for the charity whether it is to be established as either a company limited by guarantee or as a charitable trust. We can also complete the appropriate application forms on your behalf to send to the Charity Commission.
- Charity law administration and advice for all types and sizes of charity, locally and nationally.
- Charitable trust administration. Our charity and trust solicitors act for a number of grant-making charities and have many years’ experience and expertise in carrying out charity trust administration.
- Advice concerning the liability of charity trustees/directors.
- Charity documentation audit and review. Our charity lawyers can advise and assist you to ensure that your charity is operating in accordance with your constitution documents and to advise on any necessary changes. This may apply where your charity is long-established and the appropriate constitution documents have not been reviewed for some time.
- Where necessary we can make an application on your behalf to the Charity Commission for the approval of specific matters which may be in doubt, or for the approval of wider amendments to objects/scheme documents and often the depth of knowledge within our expert team means that we will have come across many similar issues before.
- Charity land law issues, including compliance with section 36 Charities Act 1993. Our specialist solicitors can advise you in respect of the necessary steps to be taken in this area.
- Advice on public benefit. Our lawyers can advise you as to whether your charity satisfies the "public benefit” requirement which is now a fundamental requirement for all charities.

- Advice and assistance with Charity Commission enquiries/investigations into the affairs of your charity.
