Deputyship
If someone is unable to deal with their own affairs and they do not have a valid Lasting Power of Attorney or Enduring Power of Attorney it may be necessary to make an application to the Court of Protection to appoint a Deputy. The Deputy will then be responsible for managing their finances.
If there is no-one suitable or willing to act as the Deputy, often the Court of Protection can appoint a Panel Deputy. Mark Dunkley, partner is one of the few Panel Deputies in Leicestershire.
We can:
- Advise regarding suitability and the obligations of a Deputy
- Prepare all necessary paperwork for the appointment of a Deputy, including obtaining the relevant medical evidence
- Make interim orders to protect and preserve assets
- Assist with the day to day management of affairs, including deputyship Accounts and Tax Returns
- Advise on the viability of Statutory Will applications and gifting applications, for example for Inheritance Tax planning, and draft necessary applications in support
Court of Protection & The Mental Capacity Act 2005
