Powers of Attorney
At Harvey Ingram, our specialist lawyers can assist in the production of a Power of Attorney if you want to ensure your affairs are dealt with carefully and safely.
The Power of Attorney gives someone else the power to handle your financial affairs on your behalf. You can give someone (or more than one person) a general power to do anything which you could do yourself, or you can restrict their power so that they are only allowed to do certain things in relation to certain assets.
Additionally, Powers of Attorney can be useful if you are planning to travel abroad, if you are away for long periods of time or if you work away and find it difficult to complete paperwork.
However, an ordinary Power of Attorney will come to an end if you lose mental capacity to make decisions about your finances.
Lasting Powers of Attorney
Personal Welfare Powers of Attorney
A Personal Welfare LPA allows your attorneys to give instructions regarding your care and treatment if you are unable to do so yourself. These largely replace advance directives which some see as old-fashioned but advance directives (or Living Wills) can still be created.
Property & Affairs Powers of Attorney
By granting a Property & Affairs LPA you give your attorneys power to make decisions regarding your finances, including your property, if you are unable to make these choices yourself. These have largely replaced Enduring Powers of Attorney (EPAs) which can no longer be created, since 30th September 2007.
