Grant of Probate is the legal process by which someone’s Will is confirmed to be valid and Executors are appointed to deal with the administration of the deceased’s estate.
If a person dies without a Will they are said to be intestate and their assets will be dealt with under the Rules of Intestacy. There are strict rules on who inherits what and also who is allowed to deal with the administration of the estate. In the case of intestacy, the Court will issue a Grant of Letters of Administration rather than a Grant of Probate.
